Hộ gia đình, cá nhân đang sử dụng đất mà không có giấy tờ về quyền sử dụng đất được cấp GCN QSDĐ, quyền sở hữu nhà ở và tài sản khác gắn liền với đất nếu thuộc một trong các trường hợp quy định tại Điều 101 Luật Đất đai 2013, cụ thể:
Trường hợp một, Hộ gia đình, cá nhân sử dụng đất trước ngày 01/7/2014 đáp ứng các điều kiện sau đây:
(i) Không có các giấy tờ quy định tại Điều 100 Luật Đất Đai 2013;
(ii) Có hộ khẩu thường trú tại địa phương và trực tiếp sản xuất nông – lâm – ngư nghiệp tại vùng có điều kiện kinh tế – xã hội khó khăn, đặc biệt khó khăn;
(iii) Được UBND xã xác nhận đã sử dụng đất ổn định và không có tranh chấp.
Trường hợp này, Hộ gia đình, cá nhân được cấp GCN QSDĐ, quyền sở hữu nhà ở và tài sản khác gắn liền với đất; đồng thời, không phải nộp tiền sử dụng đất.
Trường hợp hai, Hộ gia đình, cá nhân sử dụng đất trước ngày 01/7/2004 đáp ứng các điều kiện sau đây:
(i) Không có các giấy tờ theo Điều 100 Luật Đất đai 2013;
(ii) Đã sử dụng đất ổn định từ trước ngày 01/7/2004;
(iii) Không vi phạm pháp luật đất đai;
(iv) Được UBND xã xác nhận không có tranh chấp, phù hợp kế hoạch quy hoạch sử dụng đất, quy hoạch quản lý, xây dựng của cơ quan có thẩm quyền;
Trường hợp này, Hộ gia đình, cá nhân được cấp GCN QSDĐ, quyền sở hữu nhà ở và tài sản khác gắn liền với đất.
Ví dụ thực tế:
Gia đình ông Thạo đã sinh sống trên mảnh đất tại huyện Đông Anh từ năm 1992 nhưng không có bất kì giấy tờ nào xác nhận về quyền sở dụng đất. Đến năm 2015, Vợ chồng ông Thạo đã xin cấp giấy chứng nhận quyền sử dụng đất, sở hữu nhà ở và tài sản khác gắn liền với đất và được UBND huyện Đông Anh cấp theo đúng thủ tục. Các căn cứ cấp được đưa ra bao gồm: (i) Không có giấy tờ Giấy tờ hợp pháp về quyền sử dụng đất; (ii) Vợ chồng ông Thạo đã sử dụng mảnh đất này ổn định từ năm 1992; (iii) Không vi phạm pháp luật đất đai; (iv) Tại thời điểm xin cấp được UBND thị trấn Đông Anh xác nhận không có tranh chấp và phù hợp quy hoạch.
Lưu ý:
1. Các giấy tờ quy định tại Điều 100 Luật Đất Đai bao gồm:
(i) Một số giấy tờ được cơ quan có thẩm quyền cấp trước ngày 15/10/1993:
– Những giấy tờ về quyền được sử dụng đất được cấp trong quá trình thực hiện chính sách đất đai;
– Giấy chứng nhận quyền sử dụng đất tạm thời được cấp hoặc có tên trong Sổ đăng ký ruộng đất, Sổ địa chính;
(ii) Giấy tờ hợp pháp về thừa kế/tặng cho quyền sử dụng đất hoặc tài sản gắn liền với đất; giấy tờ giao nhà tình nghĩa, nhà tình thương gắn liền với đất;
(iii) Giấy tờ chuyển nhượng quyền sử dụng đất, mua bán nhà ở gắn liền với đất được Ủy ban nhân dân cấp xã xác nhận là đã sử dụng trước ngày 15 tháng 10 năm 1993;
(iv) Giấy tờ thanh lý, hóa giá nhà ở gắn liền với đất ở; giấy tờ mua nhà ở thuộc sở hữu nhà nước theo quy định của pháp luật;
(v) Giấy tờ về quyền sử dụng đất do cơ quan có thẩm quyền thuộc chế độ cũ cấp cho người sử dụng đất;
(vi) Các loại giấy tờ khác được xác lập trước ngày 15/10/1993 theo quy định của Chính phủ.
2. Căn cứ xác định việc sử dụng đất ổn định của hộ gia đình, cá nhân
Căn cứ xác định việc sử dụng đất ổn định của hộ gia đình, cá nhân được quy định tại Điều 125 Luật Đất đai 2013 và Điều 21 Nghị định 43/2014/NĐ-CP, bao gồm: mục đích sử dụng đất và thời gian sử dụng đất. Theo đó, việc xác định hộ gia đình, cá nhân sử dụng đất ổn định được tính từ thời điểm bắt đầu sử dụng đất vào mục đích nhất định, được thể hiện thông qua một trong các giấy tờ sau:
(i) Biên lai nộp thuế sử dụng đất nông nghiệp, thuế nhà đất;
(ii) Biên bản/quyết định/bản án liên quan đến thửa đất, tài sản khác gắn liền với đất của cơ quan có thẩm quyền;
(iii) Giấy tờ nhân thân (đăng ký hộ khẩu thường trú, tạm trú dài hạn/Giấy chứng minh nhân dân /Giấy khai sinh); hoặc giấy tờ nộp tiền điện, nước và các khoản nộp khác có ghi địa chỉ nhà ở tại thửa đất đăng ký;
(iv) Giấy tờ về việc giao, phân, cấp nhà hoặc đất của cơ quan, tổ chức được Nhà nước giao quản lý, sử dụng đất;
(v) Giấy tờ về mua bán nhà, tài sản khác gắn liền với đất hoặc giấy tờ về mua bán đất, chuyển nhượng quyền sử dụng đất có chữ ký của các bên liên quan;
(vi) Bản đồ, sổ mục kê, tài liệu điều tra, đo đạc về đất đai qua các thời kỳ;
(vi) Bản kê khai đăng ký nhà, đất có xác nhận của Ủy ban nhân dân cấp xã tại thời điểm kê khai đăng ký.
