Cấp giấy chứng nhận quyền sử dụng đất (“QSDĐ”), quyền sở hữu nhà ở và tài sản khác gắn liền với đất cho cơ sở tôn giáo đang sử dụng đất được quy định tại Luật Đất đai 2013 và Nghị định 43/2014/NĐ-CP.
Điều kiện để cơ sở tôn giáo đang sử dụng đất được cấp giấy chứng nhận QSDĐ, quyền sở hữu nhà ở và tài sản khác gắn liền với đất
Căn cứ theo quy định tại Khoản 4 Điều 102 Luật Đất đai 2013, cơ sở tôn giáo đang sử dụng đất được cấp Giấy chứng nhận QSDĐ, quyền sở hữu nhà ở và tài sản khác gắn liền với đất khi có đủ 03 điều kiện: (i) Được nhà nước cho phép hoạt động; (ii) Đất đang sử dụng phải là đất không có tranh chấp; (iii) Đất không phải được nhận chuyển nhượng, nhận tặng cho sau ngày 01/7/2004.
Thẩm quyền cấp giấy chứng nhận QSDĐ, quyền sở hữu nhà ở và tài sản khác gắn liền với đất cho cơ sở tôn giáo đang sử dụng đất
Căn cứ theo quy định tại Khoản 1 Điều 105 Luật Đất đai năm 2013, thẩm quyền cấp Giấy chứng nhận quyền giấy chứng nhận QSDĐ, quyền sở hữu nhà ở và tài sản khác gắn liền với đất cho cơ sở tôn giáo đang sử dụng đất thuộc về Ủy ban nhân dân cấp tỉnh.
Hình thức cấp giấy chứng nhận QSDĐ, quyền sử hữu nhà ở và tài sản khác gắn liền với đất
Cơ sở tôn giáo được cấp giấy chứng nhận theo hình thức giao đất không thu tiền sử dụng đất với thời hạn sử dụng ổn định lâu dài.
Trường hợp ngoại lệ:
Nếu đất của cơ sở tôn giáo đang được sử dụng vào mục đích sản xuất nông nghiệp, sản xuất lâm nghiệp, sản xuất kinh doanh phi nông nghiệp, làm cơ sở hoạt động từ thiện (kể cả đất nhận chuyển nhượng, nhận tặng cho trước 01/7/2004) thì được cấp giấy chứng nhận theo hình thức và thời hạn sử dụng đất tương ứng với mục đích đó của hộ gia đình, cá nhân.
Trình tự, thủ tục xin cấp giấy chứng nhận QSDĐ, quyền sở hữu nhà ở và tài sản khác gắn liền với đất cho cơ sở tôn giáo đang sử dụng đất
Căn cứ theo quy định tại Điều 28 Nghị định 43/2014/NĐ-CP, cơ sở tôn giáo phải thực hiện các công việc sau:
Bước 1: Rà soát, kê khai việc sử dụng đất và báo cáo với Ủy ban nhân dân cấp tỉnh
Cơ sở tôn giáo phải tự rà soát, kê khai và báo cáo UBND tỉnh về các vấn đề sau:
(i) Tổng diện tích đát đang sử dụng;
(ii) Diện tích đất của cơ sở tôn giáo theo giấy tờ chứng minh nguồn gốc đất (Đất được cơ quan nhà nước có thẩm quyền giao đất/đất nhận chuyển nhượng/nhận tặng cho/mượn của tổ chức, cá nhân, hộ gia đình khác/đất tự tạọ lập/nguồn gốc khác);
(iii) Diện tích đất đã cho tổ chức, cá nhân, hộ gia đình khác ở nhờ/thuê;
(iv) Diện tích đất bị chủ thể khác lấn, chiếm.
Bước 2: UBND cấp tỉnh xem xét, kiểm tra ra quyết định xử lý đối với diện tích đất của cơ sở tôn giáo.
Bước 3: Trường hợp diện tích đất sử dụng đáp ứng đầy đủ các điều kiện nêu trên, UBND cấp tỉnh cấp giấy chứng nhận QSDĐ, quyền sở hữu nhà ở và tài sản khác gắn liền với đất cho cơ sở tôn giáo.
Ví dụ:
Chùa Nhất Xuân là cơ sở tôn giáo đang sử dụng mảnh đất tại tỉnh Bắc Ninh, chùa nhận chuyển nhượng mảnh đất này ngày 01/10/2014; đã được nhà nước cho phép hoạt động từ năm 2009 và hiện đang không có tranh chấp với bất kì cơ quan, tổ chức, cá nhân nào khác. Theo đó, năm 2016, ban quản lý chùa Nhất Xuân làm thủ tục xin cấp giấy chứng nhận QSDĐ, quyền sở hữu nhà ở và tài sản khác gắn liền với đất. UBND tỉnh Bắc Ninh sau khi kiểm tra, xem xét phần diện tích đất chùa Nhất Xuân đã kê khai, đã ra thực hiện cấp giấy chứng nhận QSDĐ cho chùa Nhất Xuân.
Do chùa Nhất Xuân sử dụng đất với mục đích thờ cúng nên hình thức cấp là giao đất với thời hạn sử dụng đất ổn định lâu dài.
