Đối với một vụ án hình sự, một trong những căn cứ để người phạm tội bị truy cứu trách nhiệm hình sự là thời hiệu truy cứu trách nhiệm hình sự đối với chủ thể phạm tội đó còn trong thời hạn mà Luật cho phép. Đây là căn cứ quan trọng để người có quyền yêu cầu, cơ quan có thẩm quyền khởi tố cần lưu ý khi muốn khởi tố vụ án hình sự để buộc người phạm tội chịu trách nhiệm hình sự với hình vi mình đã gây ra. Bài viết đưới đây sẽ đưa đến cho người đọc những vấn đề liên quan đến quy định pháp luật về thời hạn khởi tố vụ án hình sự.
Quy định cụ thể về thời hiệu truy cứu trách nhiệm hình sự
Thời hiệu truy cứu trách nhiệm hình sự là thời hạn mà khi hết thời hạn đó thì người phạm tội không bị truy cứu trách nhiệm hình sự.
Căn cứ theo quy định tại Khoản 2 Điều 27 Bộ luật Hình sự 2015, sửa đổi bổ sung 2017 (BLHS) thời hiệu truy cứu trách nhiệm hình sự được quy định như sau:
– 05 năm đối với tội phạm ít nghiêm trọng: Tội phạm ít nghiêm trọng là tội phạm có tính chất và mức độ nguy hiểm cho xã hội không lớn mà mức cao nhất của khung hình phạt do BLHS quy định đối với tội ấy là phạt tiền, phạt cải tạo không giam giữ hoặc phạt tù đến 03 năm;
– 10 năm đối với tội phạm nghiêm trọng: Tội phạm nghiêm trọng được hiểu là tội phạm có tính chất và mức độ nguy hiểm cho xã hội lớn mà mức cao nhất của khung hình phạt đối với tội ấy là từ trên 03 năm tù đến 07 năm tù;
– 15 năm đối với tội phạm rất nghiêm trọng: Tội phạm rất nghiêm trọng được định nghĩa là Tội phạm rất nghiêm trọng là tội phạm có tính chất và mức độ nguy hiểm cho xã hội rất lớn mà mức cao nhất của khung hình phạt đối với tội ấy là từ trên 07 năm tù đến 15 năm tù;
– 20 năm đối với tội phạm đặc biệt nghiêm trọng: Có thể hiểu tội phạm đặc biệt nghiêm trọng là tội phạm có tính chất và mức độ nguy hiểm cho xã hội đặc biệt lớn mà mức cao nhất của khung hình phạt với tội ấy là từ trên 15 năm tù đến 20 năm tù, tù chung thân hoặc tử hình.
Ngoài ra, thời hiệu truy cứu trách nhiệm hình sự quy định tại Điều 27 của BLHS không được áp dụng đối với các tội phạm sau đây:
– Các tội xâm phạm an ninh quốc gia quy định tại Chương XIII của Bộ luật này;
– Các tội phá hoại hòa bình, chống loài người và tội phạm chiến tranh quy định tại Chương XXVI của Bộ luật này;
– Tội tham ô tài sản thuộc trường hợp quy định tại Khoản 3 và Khoản 4 Điều 353 và tội nhận hối lộ thuộc trường hợp quy định tại Khoản 3 và Khoản 4 Điều 354 của BLHS 2015.
Ta hiểu rằng pháp luật quy định đối với những tội phạm có áp dụng thời hiệu truy cứu trách nhiệm hình sự thì khi hết thời hạn này, cơ quan nhà nước có thẩm quyền sẽ không được khởi tố hoặc trong trường hợp đã khởi tố thì phải ra quyết định hủy bỏ quyết định khởi tố vụ án hình sự đối với tội phạm này.
Chỉ khi bị can đồng ý và yêu cầu điều tra lại thì Cơ quan điều tra hoặc Viện kiểm sát cùng cấp ra quyết định phục hồi điều tra khi đã hết thời hiệu truy cứu trách nhiệm hình sự đối với tội phạm này (Khoản 1 Điều 235 BLTTHS 2015).
Cách xác định thời hiệu truy cứu trách nhiệm hình sự
Theo quy định tại Khoản 3 Điều 27 BLHS 2015 ta có 3 cách xác định như sau:
Cách tính 1: Tính từ ngày tội phạm được thực hiện
Ví dụ: Ngày 05/01/2010 Nguyễn Văn A mượn chiếc xe máy của chị Bùi Thu B nhưng sau đó A không trả lại chiếc xe cho chị B mà đem cầm đồ được 10 triệu đồng đánh bạc bị thua hết. Do bị thua bạc và không còn xe để trả cho chị B nên A đã bỏ trốn vào miền Nam; ngày 05/10/2013 Nguyễn Văn A về gia đình. Sau khi về nhà, A hứa với chị B sẽ bồi thường chiếc xe máy cho chị, nên chị B không tố cáo hành vi phạm tội của A với Cơ quan điều tra. Sau một thời gian không thấy A bồi thường chiếc xe máy cho mình, ngày 20/02/2015 chị B đã làm đơn tố cáo hành vi phạm tội của A với Cơ quan điều tra. Tuy nhiên hành vi phạm tội của A được xác định là hành vi phạm tội lạm dụng tín nhiệm chiếm đoạt tài sản quy định tại Khoản 1 Điều 175 Bộ luật hình sự 2015 và là tội phạm ít nghiêm trọng nên đã hết thời hiệu truy cứu trách nhiệm hình sự đối với Nguyễn Văn A.
Cách tính 2: Tính từ ngày thực hiện hành vi phạm tội mới
Nếu trong thời hạn truy cứu trách nhiệm hình sự nói trên, người phạm tội lại thực hiện hành vi phạm tội mới mà Bộ luật này quy định mức cao nhất của khung hình phạt đối với tội ấy trên 01 năm tù, thì thời hiệu đối với tội cũ được tính lại kể từ ngày phạm tội mới.
Ví dụ: ngày 15/04/2017 anh A thực hiện hành vi cướp tài sản. Ngày 26/05/2017 anh A lại tiếp tục hành vi cướp tài sản. Vậy thời hiệu truy cứu trách nhiệm hình sự trong trường hợp này được tính từ ngày anh A thực hiện hành vi phạm tội sau (26/05/2017).
Cách tính 3: Tính từ ngày người có hành vi vi phạm pháp luật ra đầu thú hoặc bị bắt giữ
Đây là cách tính được đặt ra trong trường hợp người phạm tội cố tình trốn tránh và đã có quyết định truy nã. Đây là quy định nhằm tránh việc người phạm tội có hành vi vi phạm pháp luật bỏ trốn, đến khi hết thời hiệu truy cứu trách nhiệm hình sự thì quay lại.
Ví dụ: Ngày 12/03/2018, anh A có hành vi giết người. Sau khi có quyết định truy nã, anh A bỏ trốn. Đến ngày 30/12/2019, anh A ra đầu thú. Vậy trong trường hợp này thời hiệu truy cứu trách nhiệm được tính từ ngày 30/12/2019.
Hay đối với vụ án, bị cáo là bà Trần Thị Sáu (59 tuổi) bị đưa ra xét xử trước TAND TP Hà Nội sáng 2/7/2018 về hành vi giết hại hai con đẻ của mình mà bị cáo đã gây ra từ cách đây 22 năm trước. Sau khi giết hại hai con mình vào tháng 4/1996, sau khi được cơ quan điều tra cho toại ngoại vì lý do sức khoẻ bị cáo đã bỏ trốn khỏi quê hương, giấu biệt tên tuổi và thân phận của mình. Ngày 02/02/2018, lực lượng công an đến tận nhà bắt bà Sáu theo lệnh truy nã từ 22 năm trước. Như vậy, bà Sáu phạm tội giết hai người là loại tội phạm đặc biệt nguy hiểm nên có thời hiệu truy cứu trách nhiệm hình sự là 20 năm. Nếu tính từ ngày tội phạm được thực hiện, tức là đầu tháng 4/1996 thì đến đầu tháng 4/2016 đã hết thời hiệu truy cứu trach nhiệm hình sự đối với hành vi giết người của bà. Tuy nhiên, sau khi giết hai con của mình xong bà Sáu đã bỏ trốn từ Hà Tây vào Lâm Đồng, giấu biệt tên tuổi và thân phận của mình. Nên trong vụ việc này thời hiệu truy cứu trách nhiệm hình sự đối với hành vi giết người của bà Sáu được tính từ ngày bà Sáu bị bắt (tức ngày 02/02/2018).
Một số trường hợp đặc biệt trong xác định thời hiệu truy cứu trách nhiệm
Thứ nhất, đối với trường này, căn cứ theo Khoản 3 Điều 7 Thông tư liên tịch số 01/2020/TTLT-VKSNDTC-TANDTC-BCA-BQP BNN&PTNT-BTC-BTP thì trường hợp quyết định khởi tố vụ án, quyết định khởi tố bị can chỉ ghi Điều luật, không ghi Khoản và quá trình điều tra chưa chứng minh làm rõ được hành vi phạm tội thuộc trường hợp quy định tại Khoản nào của Điều luật đó thì việc xác định thời hiệu căn cứ vào khung hình phạt trong cấu thành cơ bản của Điều luật đó. Bên cạnh đó, Khoản 4 Điều 9 văn bản này cũng đưa ra quy định về trường hợp kết luật điều tra xác định bị can phạm tội thuộc Khoản của Điều luật trong Bộ luật Hình sự khác với Khoản của Điều luật ghi trong quyết định khởi tố vụ án, quyết định khởi tố bị can thì việc xác định thời hiệu truy cứu trách nhiệm hình sự căn cứ vào Khoản của Điều luật ghi trong kết luận điều tra. Quy định đưa ra các xác định thời hiệu với trường hợp thay đổi quyết định khởi tố trong cùng một Điều luật nhưng khác Khoản định khung phạt.
Thứ hai, trường hợp Cơ quan điều tra khởi tố về một tội, sau đó lại thay đổi tội danh sang tội khác hoặc Viện kiểm sát quyết định truy tố tội danh khác thì xác định thời hiệu truy cứu trách nhiệm hình sự sẽ được xác định như thế nào. Đối với trường hợp này ta căn cứ theo Khoản 4 Điều 11 Thông tư liên tịch số 01/2020/TTLT-VKSNDTC-TANDTC-BCA-BQP BNN&PTNT-BTC-BTP, trường hợp Cáo trạng truy tố bị can phạm tội thuộc Khoản, Điều của Bộ luật Hình sự khác với Khoản, Điều ghi trong quyết định khởi tố vụ án, quyết định khởi tố bị can thì việc xác định thời hiệu truy cứu trách nhiệm hình sự căn cứ theo Khoản, Điều của Bộ luật Hình sự ghi trong Cáo trạng.
Bên cạnh đó có những trường hợp xác định pháp luật hiện hành còn chưa quy định cụ thể cách xác định thời hiệu truy cứu trách nhiệm hình sự như:
– Trường hợp đã khởi tố vụ án, khởi tố bị can nhưng vì nhiều nguyên nhân khác nhau (trong đó có cả nguyên nhân khách quan và chủ quan) nên vụ án phải kéo dài như: Vụ án bị huỷ đi huỷ lại nhiều lần để xét xử lại hoặc để điều tra lại, bị trả hồ sơ vụ án để điều tra lại nhiều lần, bị tạm đình chỉ, thậm chí bị bỏ quên thì thời gian “kéo dài” vụ án có tính vào thời hạn truy cứu trách nhiệm hình sự hay không?
– Trường hợp trong vụ án có nhiều người tham gia, khi vụ án xảy ra có người phạm tội bị bắt ngay, có người phạm tội bỏ trốn. Do không tách được hành vi phạm tội của người bỏ trốn để xử lý riêng nên cơ quan điều tra đã tạm đình chỉ điều tra cả vụ án; đến khi bắt được người bỏ trốn thì thời hiệu truy cứu trách nhiệm hình sự đối với người không bỏ trốn đã hết. Vậy vấn đề xác định thời hiệu truy cứu trách nhiệm hình sự đối với người không bỏ trốn như thế nào?
Đây là trường hợp khó khăn trong việc xác định thời hiệu truy cứu trách nhiệm hình sự dẫn đến nhiều tranh cãi, quan điểm khác nhau của các thẩm phán khi xét xử và cũng là một trong những cách tiếp cận khác nhau của các luật sư dùng để bào chữa cho thân chủ của mình không phải chịu trách nhiệm hình sự.
