Thuế luôn là nguồn thu quan trọng, chủ yếu và bền vững của ngân sách nhà nước, là khoản nộp ngân sách nhà nước bắt buộc của tổ chức, hộ gia đình, hộ kinh doanh, cá nhân theo quy định của các luật thuế. Tuy nhiên, trên thực tế, nhiều tổ chức, cá nhân không thực hiện nghiêm túc nghĩa vụ thuế của mình, mà có các hành vi tránh thuế, trốn thuế. Vậy thế nào là hành vi trốn thuế? Liên quan tới lĩnh vực kinh doanh bất động sản, việc kê khai sai giá chuyển nhượng nhà đất có bị cấu thành tội trốn thuế theo quy định của pháp luật hiện hành không?
Trốn thuế là gì?
Trốn thuế là hình thức doanh nghiệp thực hiện các hành vi bất hợp pháp để không phải thực hiện nghĩa vụ thuế. Các khoản thu nhập chịu thuế, lợi nhuận chịu thuế hoặc các hoạt động chịu thuế khác bị che giấu, số tiền và/hoặc nguồn thu nhập bị trình bày sai có chủ đích, hoặc lợi dụng các yếu tố giảm thuế như khấu trừ, miễn hoặc ưu đãi thuế.
Các hành vi cấu thành Tội trốn thuế theo pháp luật hiện hành
Điều 143 Luật Quản lý thuế năm 2019 quy định về hành vi trốn thuế và Điều 200 Bộ luật Hình sự 2015 (sửa đổi, bổ sung năm 2017) quy định về các hành vi cấu thành Tội trốn thuế bao gồm:
(i) Không nộp hồ sơ đăng ký thuế; không nộp hồ sơ khai thuế; nộp hồ sơ khai thuế sau 90 ngày kể từ ngày hết hạn nộp hồ sơ khai thuế hoặc ngày hết thời hạn gia hạn nộp hồ sơ khai thuế theo quy định của pháp luật;
(ii) Không ghi chép trong sổ kế toán các khoản thu liên quan đến việc xác định số tiền thuế phải nộp;
(iii) Không xuất hóa đơn khi bán hàng hóa, dịch vụ hoặc ghi giá trị trên hóa đơn bán hàng thấp hơn giá trị thanh toán thực tế của hàng hóa, dịch vụ đã bán;
(iv) Sử dụng hóa đơn, chứng từ không hợp pháp để hạch toán hàng hóa, nguyên liệu đầu vào trong hoạt động phát sinh nghĩa vụ thuế làm giảm số tiền thuế phải nộp hoặc làm tăng số tiền thuế được miễn, số tiền thuế được giảm hoặc tăng số tiền thuế được khấu trừ, số tiền thuế được hoàn;
(v) Sử dụng chứng từ, tài liệu không hợp pháp khác để xác định sai số tiền thuế phải nộp, số tiền thuế được hoàn;
(vi) Khai sai với thực tế hàng hóa xuất khẩu, nhập khẩu mà không khai bổ sung hồ sơ khai thuế sau khi hàng hóa đã được thông quan, nếu không thuộc trường hợp quy định tại Điều 188 và Điều 189 của Bộ luật Hình sự 2015;
(vii) Cố ý không kê khai hoặc khai sai về thuế đối với hàng hóa xuất khẩu, nhập khẩu, nếu không thuộc trường hợp quy định tại Điều 188 và Điều 189 của Bộ luật Hình sự 2015;
(viii) Câu kết với người gửi hàng để nhập khẩu hàng hóa, nếu không thuộc trường hợp quy định tại Điều 188 và Điều 189 của Bộ luật Hình sự 2015;
(ix) Sử dụng hàng hóa thuộc đối tượng không chịu thuế, miễn thuế, xét miễn thuế không đúng mục đích quy định mà không khai báo việc chuyển đổi mục đích sử dụng với cơ quan quản lý thuế.
Kê khai sai giá chuyển nhượng nhà đất có bị cấu thành tội trốn thuế không?
Hành vi kê khai sai giá chuyển nhượng quyền sử dụng đất và tài sản trên đất (cụ thể kê khai thấp hơn giá chuyển nhượng thực tế) là hành vi cấu thành tội trốn thuế.
Đối với một giao dịch bất động sản được các bên ký nhiều loại hợp đồng (hợp đồng đặt cọc, hợp đồng chuyển nhượng, văn bản thỏa thuận…) với số tiền khác nhau, sau đó sử dụng hợp đồng có nội dung ghi nhận giá trị chuyển nhượng thấp để khai thuế, thì được xem là tài liệu không hợp pháp.
Theo đó, hành vi kê khai sai giá chuyển nhượng nhà đất bị coi là hành vi “sử dụng chứng từ, tài liệu không hợp pháp khác để xác định sai số tiền thuế phải nộp, số tiền thuế được hoàn” cấu thành tội trốn thuế.
Tuy nhiên, không phải mọi hoạt động kê khai sai giá chuyển nhượng nhà đất đều bị coi là hành vi cấu thành tội trốn thuế. Bởi lẽ, hành vi trốn thuế chỉ bị coi là tội phạm khi số tiền trốn từ 100 triệu đồng trở lên hoặc dưới 100 triệu đồng nhưng người trốn thuế đã bị xử phạt hành chính hoặc đã bị kết án và chưa được xoá án tích về hành vi trốn thuế hoặc một số trường hợp khác theo quy định tại Điều 200 Bộ luật Hình sự 2015.
Do cá nhân, tổ chức thực hiện việc kê khai thuế theo nguyên tắc tự kê khai, tự chịu trách nhiệm, nên trên thực tế việc kê khai sai giá chuyển nhượng nhà đất để được giảm mức thuế phải nộp vẫn diễn ra khá phổ biến.
Ví dụ: Hiện nay, UBND quận Thanh Xuân, thành phố Hà Nội tiến hành rà soát hoạt động chuyển nhượng bất động sản trên địa bàn quận. Theo đó, UBND quận đã gửi công văn yêu cầu giải trình đối với các trường hợp mà giá trị chuyển nhượng trên hợp đồng mua bán thấp hơn so với giá thị trường. Ngoài ra, đối với các trường hợp này, UBND cũng có công văn tới cơ quan công an quận để phối hợp, hỗ trợ điều tra hành vi vi phạm của người nộp thuế.
Xử lý các trường hợp kê khai sai giá chuyển nhượng nhà đất
Các trường hợp kê khai sai giá chuyển nhượng nhà đất bị áp dụng các biện pháp bắt buộc bổ sung khoản thuế bị thiếu hoặc áp dụng các mức phạt quy định tại Điều 200 Bộ luật Hình sự 2015.
