Việc kiểm soát dịch bệnh vô cùng căng thẳng và phức tạp, đòi hỏi sự phối hợp của nhiều cơ quan chức năng cũng như ý thức tự giác phòng dịch của người dân. Tuy nhiên, thực tế cho thấy việc nhập cảnh trái phép từ các quốc gia đang có dịch vào Việt Nam khiến cho công tác kiểm soát dịch bệnh gặp nhiều khó khăn. Việc nhập cảnh trái phép vào Việt Nam là hành vi trái pháp luật, đặc biệt trong giai đoạn dịch bệnh như hiện nay thì hành vi này càng tiềm ẩn nhiều rủi ro gây nguy hiểm cho cộng đồng. Vậy, theo quy định của pháp luật, hành vi nhập cảnh trái phép vào Việt Nam sẽ bị xử lý như thế nào?

Nhập cảnh trái phép là gì?
Nhập cảnh trái phép được hiểu là hành vi nhập cảnh vào Việt Nam không thông qua các thủ tục theo quy định của pháp luật về xuất, nhập cảnh. Đây là một hành vi bị nghiêm cấm theo quy định của Luật nhập cảnh, xuất cảnh, quá cảnh, cư trú của người nước ngoài tại Việt Nam.
Nhập cảnh trái phép vào Việt Nam bị xử lý như thế nào?
Theo quy định của pháp luật hiện nay, hành vi nhập cảnh trái phép vào Việt Nam sẽ bị xử phạt vi phạm hành chính và bị truy cứu trách nhiệm hình sự.
Xử phạt vi phạm hành chính
Theo quy định tại Khoản 3 Điều 17 Nghị định 167/2013/NĐ-CP, hành vi trốn hoặc tổ chức, giúp đỡ người khác trốn vào các phương tiện nhập cảnh, xuất cảnh nhằm mục đích vào Việt Nam sẽ bị xử phạt từ 3.000.000 đồng đến 5.000.000 đồng.
Ngoài ra, tuỳ vào mức độ vi phạm có thể áp dụng hình thức xử phạt trục xuất khỏi Việt Nam.
Truy cứu trách nhiệm hình sự
Việc truy cứu trách nhiệm hình sự đối với hành vi nhập cảnh trái phép vào Việt Nam được thực hiện khi người nhập cảnh trái phép đã từng bị xử phạt vi phạm hành chính về hành vi này. Theo Điều 347 Bộ luật hình sự 2015 (sửa đổi, bổ sung 2017), mức xử phạt được quy định như sau:
– Phạt tiền từ 5.000.000 đồng đến 50.000.000 đồng; hoặc
– Phạt tù từ 06 tháng đến 03 năm.
Việc nhập cảnh vào Việt Nam trong giai đoạn dịch bệnh Covid–19 được quy định cụ thể ra sao?
Theo quy định tại Thông báo số 118/TB-VPCP do Văn phòng Chính phủ ban hành ngày 21 tháng 3 năm 2020 về Kết luận của thủ tướng chính phủ Nguyễn Xuân Phúc tại cuộc họp thường trực chính phủ về phòng, chống dịch Covid-19:
– Tạm dừng nhập cảnh đối với tất cả người nước ngoài vào Việt Nam, áp dụng từ 0 giờ ngày 22 tháng 3 năm 2020. Riêng đối với trường hợp nhập cảnh với mục đích ngoại giao, công vụ và các trường hợp đặc biệt (khách nước ngoài tham dự, phục vụ các hoạt động đối ngoại quan trọng; chuyên gia, nhà quản lý doanh nghiệp, lao động kỹ thuật cao…), Bộ Công an, Bộ Quốc phòng chủ trì, phối hợp với Bộ Ngoại giao, Bộ Y tế và các cơ quan liên quan thực hiện cấp thị thực (nếu cần) và các thủ tục kiểm tra, khai báo y tế bắt buộc tại khu vực riêng và được cách ly phù hợp tại cơ sở lưu trú theo đúng quy định. Cơ quan đại diện các nước tại Việt Nam có hình thức cam kết thực hiện giám sát y tế đối với công dân nước mình trong thời gian công tác ở Việt Nam.
– Tạm dừng nhập cảnh vì lý do dịch bệnh đối với tất cả các trường hợp mang Giấy miễn thị thực được cấp cho người gốc Việt Nam và thân nhân, áp dụng từ 0 giờ ngày 22 tháng 3 năm 2020. Giao Bộ Y tế chịu trách nhiệm triển khai thực hiện theo đúng quy định của pháp luật.
– Các cơ quan chức năng thực hiện nghiêm việc kiểm soát người nhập cảnh cả đường biển, đường thủy, đường bộ và đường hàng không.
