Một là, thành lập tổ chức kinh tế theo quy định của pháp luật nước tiếp nhận đầu tư;
Hai là, đầu tư theo hình thức hợp đồng ở nước ngoài;
Ba là, góp vốn, mua cổ phần, mua phần vốn góp của tổ chức kinh tế ở nước ngoài để tham gia quản lý tổ chức kinh tế đó;
Bốn là, mua, bán chứng khoán, giấy tờ có giá khác hoặc đầu tư thông qua các quỹ đầu tư chứng khoán, các định chế tài chính trung gian khác ở nước ngoài;
Năm là, các hình thức đầu tư khác theo quy định của pháp luật nước tiếp nhận đầu tư.
Trong những năm gần đây, nền kinh tế của Việt Nam đã phát triển mạnh mẽ và vững chắc hơn, đó cũng là một trong những lý do thôi thúc những nhà đầu tư trong nước mở rộng quy mô kinh doanh, khám phá và đầu tư ra nước ngoài để tìm kiếm nguồn lợi nhuận mới, môi trường kinh doanh mới cũng như là phát triển những chiến lược mới, tiếp cận văn hóa kinh doanh thế giới. Ngành, nghề cấm đầu tư kinh doanh quy định tại Luật Đầu tư và các điều ước quốc tế có liên quan, các ngành, nghề có công nghệ, sản phẩm thuộc đối tượng cấm xuất khẩu theo quy định của pháp luật về quản lý ngoại thương và theo quy định của pháp luật nước tiếp nhận đầu tư, cụ thể bao gồm: Kinh doanh các chất ma túy; Kinh doanh các loại hóa chất, khoáng vật; Kinh doanh mẫu vật các loài thực vật, động vật hoang dã có nguồn gốc khai thác từ tự nhiên quy định Công ước về buôn bán quốc tế các loài thực vật, động vật hoang dã nguy cấp; mẫu vật các loài thực vật rừng, động vật rừng, thủy sản nguy cấp, quý, hiếm Nhóm I có nguồn gốc khai thác từ tự nhiên; Kinh doanh mại dâm; Mua, bán người, mô, xác, bộ phận cơ thể người, bào thai người; Hoạt động kinh doanh liên quan đến sinh sản vô tính trên người; Kinh doanh pháo nổ; Kinh doanh dịch vụ đòi nợ.
Ngành nghề đầu tư ra nước ngoài có điều kiện bao gồm: Ngân hàng; Bảo hiểm; Chứng khoán; Báo chí, phát thanh, truyền hình; Kinh doanh bất động sản. Đối với các ngành, nghề ngân hàng, bảo hiểm, chứng khoán, nhà đầu tư phải đáp ứng điều kiện theo quy định của pháp luật trong lĩnh vực ngân hàng, bảo hiểm, chứng khoán và được cơ quan có thẩm quyền chấp thuận bằng văn bản. Đối với ngành, nghề báo chí, phát thanh, truyền, nhà đầu tư là tổ chức đã được cấp phép hoạt động báo chí, phát thanh, truyền hình tại Việt Nam và được Bộ Thông tin và Truyền thông đồng ý bằng văn bản. Đối với ngành, nghề kinh doanh bất động sản, nhà đầu tư là doanh nghiệp thành lập theo Luật Doanh nghiệp.
Thứ ba, Nhà đầu tư có cam kết tự thu xếp ngoại tệ hoặc có cam kết thu xếp ngoại tệ để thực hiện hoạt động đầu tư ra nước ngoài cửa tổ chức tín dụng được phép.
Thứ tư, nhà đầu tư phải có quyết định đầu tư ra nước ngoài theo quy định tại Điều 59 của Luật Đầu tư. Việc quyết định đầu tư ra nước ngoài của doanh nghiệp nhà nước thực hiện theo quy định của pháp luật về quản lý, sử dụng vốn nhà nước đầu tư vào sản xuất, kinh doanh tại doanh nghiệp và quy định khác của pháp luật có liên quan. Đồng thời phải có văn bản của cơ quan thuế xác nhận việc thực hiện nghĩa vụ nộp thuế của nhà đầu tư. Thời điểm xác nhận của cơ quan thuế là không quá 03 (Ba) tháng tính đến ngày nộp hồ sơ dự án đầu tư.
